2)Although it rarely happens, we have to state that prices are subject to change without notice. We reserve the right to correct pricing errors.
3)All information, documents, images, and HTML formatting are copyrighted and may not be reused or copied without permission. We fully pursue those unscrupulous individuals who lack creativity and use our proprietary information for their purposes.
4)Wines may be sold only to persons at least 21 years of age. By placing an order, you are warranting to us that you are 21 years of age. Any order placed by someone under 21 constitutes fraud.
5) Wines may be delivered only to persons at least 21 years of age. Our shippers will require a signature of someone at least 21 years of age at the time of delivery. Positive ID may be required. If the wine is returned to us for failure to provide positive proof of age, the customer is responsible for paying the return shipping charges.
6)Unless SPECIFICALLY DECLINED, all orders will have insurance charges added. The charge is $.50 per $100 and covers breakage or loss. WEATHER DAMAGE IS NOT COVERED BY THIS INSURANCE! Wine Exchange LLC will cover the insurance for the first $42 of bottle price. See item #10, below.
7)All wine is sold in California, and title passes to the buyer in California. We make no representation relative to your right to import wines into your state or county. The customer, by placing an order, warrants to us that he/she is aware of and in compliance with the laws governing said shipment into his/her area. All orders shipped outside of CA are not subject to CA state sales tax. ALL ORDERS PICKED UP AT OUR LOCATION ARE SUBJECT TO SALES TAX-NO EXCEPTIONS! If Wine Exchange LLC failed to add sales taxes when the order was placed, Wine Exchange LLC reserves the right to correct and collect any sales taxes due.
8)Customer is solely responsible for shipment of wines. Unless you instruct us otherwise, you agree that we shall arrange, on your behalf and responsibility, shipment with a common carrier to make the delivery. We reserve the right to determine the propriety of shipping instructions and may refuse to ship if we deem it inappropriate or unsafe. If shipment is returned for any reason other than Wine Exchange LLC's error, the customer must pay any additional shipping required.
9)All completed orders will be shipped as soon as practicable using the Air or Ground option you selected. Wine Exchange LLC cannot be responsible if you change your mind after ordering or choose a shipping option in error. An order with both "futures/prearrivals" and in-stock items will have the in-stock items shipped immediately.
10)Wine Exchange LLC assumes no liability for wine damaged due to poor weather during transport. This can include leakage, freezing, or corks pushing out of the neck. So, be sure of shipping conditions before placing a ship order.
11)If your area is experiencing extreme weather conditions, Wine Exchange LLC will "hold" wines for future shipment. Wine Exchange LLC WILL NOT "hold" wines for the sake of convenience, ONLY for extreme weather conditions. A nominal fee is required ($5.00 ON THE FIRST ORDER) and a restocking or cancellation fee (10% or $25.00, at our discretion) will apply to changes to "hold" or "pre-arrival" orders. If "hold" wines are damaged due to an Act of God, Wine Exchange LLC cannot be held responsible. If "hold" orders are not shipped within six months of purchase or by 10/31 (for summer holds) and by 4/30 (for winter holds), whichever is sooner, we may assess additional storage fees in any amount or sell the items solely at our discretion, and our liability to you in such cases is limited to the original transaction price.
12)For "hold" and "pickup in-store" orders, we require a 6 bottle minimum purchase per order. For "pre-arrival" orders, Wine Exchange LLC requires 3 bottles minimum per item, and 6 bottles total per order. In some few cases (notably Port and pre-determined combination Packages), we may require a slightly larger order. "Hold" and "pre-arrival" orders cannot be combined to meet these minimums. If you combine "futures/prearrivals" and in-stock items, we will ship the in-stock, non-futures portion of your order immediately. No shipping charge will be assessed on futures/pre-arrival purchases UNTIL the order is shipped.
13)On older vintages, we make every effort to secure wines that are in top condition, and we do not accept questionable goods. For wines that are five years old or older, it is the industry standard and the policy of Wine Exchange LLC that such wines are purchased at the buyer's risk in case of a problem.
14)No sales to retailers.
15)"Pickup in-store" orders must be picked up by the customer (or agent) within 6 weeks of the date of the order. After 6 weeks Wine Exchange LLC may asses storage fees and may cancel the order at its discretion. Our liability in such cases is limited to the original transaction price. "Pickup in store" purchases are subject to a six bottle minimum or $200 per order, and Wine Exchange LLC may refuse any order not meeting this minimum.
16)A small shipping surcharge will be added to orders containing sparkling wine, due to the greater weight of these bottles.
17)Shipping charges for glassware, accessories, and future/prearrival items will be added to your order. Shipping charges for these items ARE NOT included on your invoice and we will add them later!
18)If you require delivery by a specific date, please use the "Special Instructions" field to let us know so we can meet your needs.
19)Wine Exchange LLC requires that each order contain the correct billing address for the credit card used. If we are unable to verify the billing address information you provided, then Wine Exchange LLC will be UNABLE to accept your order and shall have no liability regarding your ability to obtain a particular item or the timeliness of shipment.
20)Distilled spirits can ship to the state of CA only.
